NATIONAL DO NOT CALL REGISTRY LAUNCHES

The Federal Trade Commission's much-anticipated National Do Not Call Registry is open for business. The Registry, which launched June 27, allows consumers to register to not receive telemarketing calls. All real estate licensees who cold call will now have to comply with the provisions of the National Do Not Call Registry. An exception in the registry allows practitioners to call contacts whose names are on the list as long as the practitioner and contact have an established relationship.

As the FTC defines "established relationship," calls can be made to contacts for up to 18 months after a business transaction and three months after an inquiry or application. Do Not Call list enforcement begins Oct. 1.

The FTC rules apply to calls made across state lines, but in a separate rulemaking, the Federal Communications Commission has extended coverage of the registry to calls made within a state. These federal rules constitute a floor and therefore supersede all less-restrictive state do-not-call rules.
